Terms of Service

About these terms

These terms are an agreement between you and Pieter Meyer, of Zürich, Switzerland, who offers Elysium under the name Elysium Labs (not a registered company). In these terms, “we” and “us” mean Pieter Meyer. Until our postal address is published here, you can reach us at legal@elysium-labs.ai.

They apply to this website, Ask Elysium, the early-access list, Elysium accounts and the hosted Elysium app (together, “Elysium”). They do not cover buying hardware: if we offer an Elysium hub or other devices, separate terms will apply to them.

You accept these terms when you create an account or accept an invitation to a household. If you use the website or Ask Elysium without an account, the rules on acceptable use below apply to that use. How we handle personal data is set out in our Privacy Policy.

Early access

Elysium is in early access. We open it to a small number of households at a time, by invitation, and joining the early-access list does not entitle you to an invitation. Early access is free.

During early access, Elysium is still being built. Features can change, be added or be removed, and the service can be unavailable at times. We tell account holders by email about changes that matter to how they use Elysium.

Accounts and households

  • You must be at least 18 to create an account or to manage a household.
  • An adult who manages a household can invite other residents, including children, and decides the role each one has. That adult is responsible for the children in the household using Elysium appropriately, and for any guest they let in.
  • Keep your sign-in details to yourself, and tell us at security@elysium-labs.ai if you think someone else has used your account. We recommend turning on two-step verification.
  • Your account is personal: do not share it or transfer it.

Acceptable use

Do not use Elysium to:

  • break the law or harm other people, their devices or their data;
  • try to reach data or homes that are not yours;
  • overload or disrupt the service, get around its limits (including those on Ask Elysium), or use it with automated tools beyond ordinary use;
  • probe, scan or test its security, except as our vulnerability disclosure policy allows;
  • resell Elysium or build a commercial service on it without our written agreement.

We may suspend an account that breaks these rules. Unless there is an urgent risk to other people or to the service, we warn you first.

Answers from AI

Ask Elysium and The Butler use AI models, and their answers can be inaccurate or incomplete. The Butler can also misunderstand a request or act on the wrong device. Check anything important before you rely on it, and do not treat their answers as professional advice, whether medical, legal, financial or of any other kind.

Your household decides which devices and capabilities The Butler may use in your home: its admins and members can turn capabilities on and off again at any time.

Not a safety or medical system

Elysium is not a medical device, an alarm system or an emergency-call service. Do not rely on it to detect emergencies, to look after anyone's health or safety, or to call for help, and keep your smoke detectors, alarms and medical alert devices. In an emergency, call the emergency services yourself: 112 in Switzerland and the EU, or 144 for an ambulance in Switzerland.

Your content

What you put into Elysium, such as conversations, memories, settings and images, remains yours. You allow us to store and process it only to run Elysium for you, as our Privacy Policy describes. We do not use it to train AI models, and the API terms of our AI providers do not let them train on it.

If you send us feedback or ideas, we may use them to improve Elysium without owing you anything for them.

Images and films on this site

The films on this website, and its images of our products and of people at home, were made with generative AI tools, among them Seedance 2.0 for the films. Their scenes, the people in them and what their screens and devices show were generated, and none of them is a recording of Elysium in use, and captions on the site say they are AI-generated. The photographs of our team are real photographs, the charts and diagrams in our research reports are vector drawings made for those reports, and our logo and icons are drawings of our own.

Other services

Elysium relies on other companies, such as Amazon Web Services for hosting and Anthropic and OpenAI for AI models; the Privacy Policy lists them all. Services your household connects, such as an email account, a calendar feed or a computer, are provided by others under their own terms, and we are not responsible for them.

Price

Early access is free. If we want to charge for Elysium in the future, we will tell you in advance, and you will pay only if you agree to it.

Liability

Because early access is free, we do not promise that Elysium will always be available, that it will be free of errors or that it will suit a particular purpose.

We are liable without limit for damage we cause intentionally or through gross negligence, for injury to life, body or health, and wherever the law does not allow liability to be limited. Apart from that, we are not liable for damage caused by slight negligence.

Nothing in these terms limits the rights you have as a consumer under the mandatory law of the country where you live.

Ending your use

You can stop using Elysium and delete your account at any time on your Account page.

We can end early access, or your account, with at least 30 days' notice by email. We can act sooner if you seriously or repeatedly break these terms, or if the law or the security of the service requires it. Before we end the service, we tell you how to get a copy of your data.

Changes to these terms

We may change these terms, for example when Elysium changes or the law requires it. We email account holders at least 30 days before a change that affects them takes effect, and update the date at the top. If you do not agree, you can delete your account before then; if you keep using Elysium after that date, the new terms apply.

Governing law and courts

Swiss law applies to these terms, without its rules on conflicts of laws. The courts of the city of Zürich have jurisdiction.

If you are a consumer, you keep the protection of the mandatory law of the country where you live, you can also bring a claim before the courts there, and we can bring a claim against you only there.
